DISTRICT COURT.
THIS DAY. (Beforo His Honor .Deputy Judge Wardell.) . James Toomath applied for his discbarge. Mr Skipper for the debtor said that the Trustee had not done his duty by filing a report and asked the Court not to allow his client's interests to be prejudiced by the neglect of the Trustee, The Court thought the proper course would be to make an order calling upon tbe Trustee to report. Mr Skipper said tbe opposition of the Trustee appeared to be altogether of a negative character. A meeting of creditors passed a resolution recommending the debtor's discharge. W. Sellar, called, confirmed the statement made by Mr Skipper. He had spoken to Mr F. Gray, the Trustee, who said he would draw up a report if Mr King, the debtor's partner, applied for his discharge, but he did not care to draw up one' for Mr Toomath done.
The Court suggested that the application should be adjourned and the debtor obtain the attendance of the Trustee.
Mr Skipper said this could only be done by a summons. W. Sellar, in reply to the Court, said that as far as he knew there was no objection on the part of the creditors to the discharge. The Court decided to grant the order of discharge. Mr Bunny applied for an order for
costs in the case of Bentley v the Borough Council, The Court expressed its intention of giving.effect to Judge Davie's opinion that the expenses of the witnesses might be deducted from the costs awarded.
D. Knight. The public examination of the debtor was further adjourned for a month by arrangement between counsel.
