Mr Sandi« lands for plaintiffs, Mr Beard for defen-. .dant, This was a claim for work and labor done upon 33 chains of road at 40s a chain, From the evidence of the plaintiffs it appeared that they undertook to make a road for defendant. A written agreement was prepared and signed by the parlies. Afterwards some farther words were added to the agreement statx ing that the grade ; of the road was not to be more than one' in twenty feet. After working for two months plaintiffs arrived at a place where it waß impraotible to make the road even at three in twenty feet, As the defendant declines! to make any concession, plaintiffs threw up the work and now sued for the value of the work done, The Court nonsuited the plaintiffs with costs £5 ss, There were a number of cases in which judgment was entered on contassion or the amount paid into Court. ■,,-,. ■ GREYTOWN-TUESDAY. 1 (Before H.
