He knew the horse, having been working with it during the time Shute and Jones had it. The horse did not work well, He could manage it after a fashion. He did not speak to Von Redin about the horse. He remembered taking the horse to a blacksmith and saw Yon Redin there, but did not remember what he said to him. The, horse was supposed to be broken in when'first it came to Shute and Jones'. Ho kd on several .occasions complained to Jones about the horse, but did not remember the horse sticking him up opposite to Shute and Jones'. '; . In answer to Mr Beard, witness said the horse did not improve with work and would often rear. By Mr Bunny: Did you ever tell Jones that the horse was of no use to you? Witness: No, I don't remember it. Jas. Jones, of the firm of Shute'and Jones, said he had Von Redin's horse to work, and it was with him about five months. The first day he worked the horse went well, but his opinion altered afterwards. O'Brien had told him that the horse worked fairly well, but he (witness) did not see the horse often, Von Redin asked him once or twice about the horse. He was not at home when Von Redin came for the horse, but he spoke to Mrs Jones. Gross-examined by Mr Beard : O'Brien had not told him about the horse's rearing, but had complained of the horse in general. When the horse went to Alfredion be refused to pull, but this was soon after he had him. He saw the horse at Mr Shute's, and after that changed his opinion, thinking the horse was not of much use. .'. The Court gave judgment for plaintiff with costs £ll ] ss.
