DISTRICT COURT.
MASTERTON-THIS DAY. BmLY v the Mayor and Corporation of Masterton, The following judgement was read by the District County Clerk:—ln this case the defendants have proved to the satisfaction of the Court that the plaintiff did, as alleged in the statement of defence, misconduct himself in his office as poutidkeeper and in the performance of the duties thereof, by the mode in which he conducted the sale therein referred to, and that the conduct of the plaintiff in relation to such sale was of such a nature as to destroy confidence in him as a public officer and to render it incumbent on the defendants to remove him ftom such office. The Court, therefore finds that the plaintiff was rightfully dismissed, and is not entitled to recover damages in respect of such dismissal. " With regard to the claim for 193 3d balance of salary, the Court finds that no legal tender thereof was made prior to payment in Court. Judgment for plaintiff for amount paid into Court only, Costs accordingly,
