R.M. COURT.

MASTERTON-THIS DAY. (Before H. S. Warden, E,M.) John Dunscombo was charged with indecent language in the public street, • Sergeant McArdle deposed that the offensive language was used in Queen street between 12 and 1 o'clock in the day time. Fined 10s or 48 hours' hard labor, Edward Perry was charged with assaulting Carl Moeller, Mr Beard appeared for informant, The defendant pleaded not guilty. Carl Moeller deposed: I am an upholsterer residing in Masterton. I had occasion to go to the defendant's .house re a business transaction; In. the course of conversation I told the defendant he was clever, when he got up and struck me. I got out of the house, and he followed me, wanting to fight, and calling me a b German pig. I was struck on the eye, and on the side of the head. Mrs Perry was the only other person in the house. (To informant), I agreed to send you another perambulator in placo of the one you returned. Your Missis bought the perambulator, I went to your liouse because the perambulator was sent back, and I wanted an explanation of the reason why it .was sent back. . ;

Mr Beard: When was tho perambulator returned 1 Witness: It was sold on the 25th of March and returned on tho 22nd of April, Then it was arranged'that it should be exchanged for a better one. Mrs'Parkes called deposed that she resided opposite the Empire Hotel, She observed Perry and. Moeller on Tuesday last standing out in the road. She heard.Perry call Moeller a German pig, and then she turned her back on them,, Moeller spoke to witness before Perry called him "a German pig." Was with Mrs Broadbent at the time —witness and Mrs Broadbent walked away.

Mrs Broadbenfc called for the defence stated that she heard Mr Peny order Mr Moeller off his verandah, and also heard him call him "a German p!g." Perry ordered Moeller off several times and then took him by the shoulders and" pushed him off. To Mr Beard : Mrs Parkes did not see as much as witness did, because she turned her head, Mrs Perry, wife of the defendant, deposed, that Moeller gave her the lie, and her husband ordered him out of the house. When Moeller would not go, her husband caught him by the shoulder and put him out, (To Mr Beard,)' Moeller and her husband were talking about the workmanship of the perambulator. Witness kept the perambulator four or five weeks before returning it. Could not repeat exact words used, but Moeller calledher husband a bully and herself a liar. He gave her 'the lie 1 by saying he did not think she left the perambulator at the shop tho night before. Defendant said that he asked Mr Moeller into the house in a friendly spirit,, and treated him well, until Moeller gave bis wifeUe.lie. The Court said the defendant had. the right to put Moeller out of his house when he refused to leave;- but; when it came to a black eye, H'was a'' different matter. The defendant w'oultl be fined twenty shillings,
