MASTERTON—THIS DAY,
(Before A. W. Renall, W, Lowes, and W..-H, Hosking, J.P's.)
Carew Thomas Ellers appeared on the remanded charge of wife desertion. The Court said they had no power to deal with the case;
Mr Beard said the Court had power to dismiss the case, and it was scandalous to remand his client, He recognised that the fault did not lie with Mr Wardell' who was bundled about from place to place by the Government from day to day. Mr Bunny opposed the case being dismissed. He asserted that there was a strong case against the accused and that tho informant's interests should not bo prejudiced by the absence of the Resident Magistrate, He asked for an adjournment till Thursday next. Mr Beard asked the Court to dismiss the information if only to show that the Government did not make proper provision for the administration of justice.
The Court doubted whether the Court could take the responsibility of dismissing ah information on'such a ground. No doikbfc bail could be readily i'ertewed, *•' . Mr Bunny suggested the accused should lodge-one hundred pounds as bail,.
Mr Beard admired this proposal. The Court had marked its view of the case at last sitting by fixing the bail at ten pounds, Mr Bunny understood that defendant recently came into possession of £SOO or £7oo—(Mr Beard: A thou sand). Ho thought he would be in a position to deposit a liunered, Mr Lowes thought it was an unfortunate thing that the case could not be dealt with at the present sitting, It would be most unfair to increase the bail.
The case adjourned till Thursday, tho same bail being accepted as before. Herbert Marsli was charged, with threatening to cut his wife's nose, off, and to cut off the head of one. of his children, Defendant did not nut in an appearance,
_ Sergeant McCardle stated that tho information las laid at' the request of Mrs Marsh, and now sho desired to withdraw it.
Mr Kenall: Like they always do 1 ' Dr Hosking: Are you not afraid of a repetition of the offenco ? ' Mrs Marsh: Oh, no I:Dr Hosking: Did he strike you ? Mrs Marsh: No j I him. Dr Hosking: That's-right: always have the first slap".. " r \ Case withdrawn, 1
