Rapp k Hare v James ToomathDebt LU 17s ii Mr Beard for plaintiff. Defendant pleaded bankruptcy. In answer to the Court he said he had not received his discharge, Tho Court: I understand that you. admit the debt subject to this objection. Defendant: No, your Worship, W. Rapp, sworn, deposed that defendant had never disputed the account, but on more than one occasion he had promised to pay'it. The last promise made was about four months ago. Defendant: Bid I say there were several little things iii tho account that I would like corrected?.. Plaintiff: YeC ™; Defendant: po. 'you remember my asking you whether I should include your account in my schedule when I filed 1 Plaintiff: I do not, , He defendant, asked for an adjourn* ment tafprove a contra of Charles Hare's which plaintiffs allowed as a set off. Plaintiff said, Toomath had been credited with an order given by Charles Hare, and produced his ledger to this. $k The Court said it would proof that plaintiff agreed to liquidate any further balances of C. Hare's debt to King and Toomath, other than the amount credited in Eapp and Hare's books. It asked witness if Eapp and Hare had become responsible for any further balances ? Witness: No! I know nothing about it. Defendant; You never do know.,, anything when it's against your own interests! I am very soiry for Mr Kapp's short memory, Mr Kapp thought his memory was good enough, The Clerk of the District Court produced, at the request of'the defendant, a declaration of the bankruptcy of Toomath and King,. '. ; Mr Beard stated.that the account of Kapp and Hare was not included, in the schedulo of liabilities. The defendant asked if a bankrupt could be Buedl (Left sitting.)
