CARTERTON-WEDNESDAY,< [Before H. S. Wardell, R.M.] Thomasßavies v. C. Sage and others Plaintiff claimed ,to recover from defendant's possession of certain goods under a bill of sale, which.goods were alleged to be in possession o"f the defendants' and.vnlued at £45. Mr Sandilands for plaintiff, and Mr Gray for defendants. An attempt was made by the defendant to upset thebill of saleon the 'ground of fraud,, there being no real .consideration, andMra Sage, one .of the defendants, 1 was called to give "evidence to that,effect, but this was ■disallowed by the Court, and judgment entered for the plaintiff for the restoration of the goods or the payment of .£45 value. ; ; .■ ; , ; . •■ •' ; " ".
