THE NEW PENAL CODE.
Tho New York Penal Code adopted by the ; Legislature in 1881 went into effect the first day of Docember last year. It is especially stringent as to Work and traffic on Sunday; and in this respect it is a benign law, to bo cordially acquiesced in by all'clasßes, . and should enlist the hearty co-opera-tion of all .to secure its enforcement. . The sections .relating to; Sunday observance are as follow: '., Penal Code—Title 10,- Chapter 1. ;' Section- 259: The' Sabbath—The • first day of the week being by/general ' . oonsent set apart for a day of rest and . religious use, the law prohibits the . doing on that day of certain acts hereinafter specified, which' are serious interruptions of the repose and religious liberty of tlis community.. ' , '.Section 260: Sabbath Breaking.— A violation of tho foregoing prohibition is Sabbath Breaking. . Section 261: Day Defined—Under the term " day," as employed in the phrase" first day of the week," when used in this chapter, is included all the time from midnight to midnight. ' Section 262; Acts Forbidden.—The following acts aro prohibited and forbidden to be done on the fust day of ' the week: 1. Servile labor. ' 2. Public sports and shows. 3. manufactures, ormechanic#t»'3poyments. 4. Public traffic. 5. Serving process, Section 263: All manner of servile labor on tho first day of the week is prohibited, except in works of necessity or charity. Section 264 :It is a sufficient defence to a prosecution for servile labor on the first day of the weok that the defendant uniformly keeps another day of the week as holy time, and does not labor upon that day, and that the labor complained of was clone in such manner as not to interrupt or disturb other persons in observing the first day of the week as holy time, Section 265: All shooting, hunting, fishing, playing, horse racing, gaming, or other public sports, exercises, pastime's, or shows, upon tho first day of the week, and all noise disturbing the peace of the day are prohibited. Section 260; Trades—All trades, manufactures, and mechanical employments upon the first day of the week are prohibited,
Section 267: Public Traffic-All .manner of public selling or offering, or exposing for sale publicly of any comniodities upon the first .day of the week is prohibited,, except that meats, milk and fish may be sold at any time before nine o'clock in the morning, and except that food may be sold to be eaten upon tho premises where sold, iitid "drugs, medicines, and surgical appliances may be sold at any time of tho day, Section 269: Punishment of . Sabbath-breaking. Sabbath-breaking is a misdemeanor punishable by a fine not less than Idol, and not more than lOdol, or by imprisonment in the county gaol not exceeding five days, or by both. Section 280 : Forfeiture of commodities offered for sale—ln additition to the penalty imposed by the last sec* '.tion, all commodities exposed for. sale biithe firat day of the week, in violation of tbe provisions of this chapter, 'shall be forfeited... Upon conviction of the offender bya Justice of the Peace of'a county, or a Mayor, recorder, or ..'alderman of a city, such officer shall issue a warrant for the seizure of tbe ''forfeited articles, which when seized, ; shaH'be sold on one day's notice, and the proceeds given to the ov'orseers of the'poor for the use of the poor of tho town or city,
