FEATHERSTON— MONDAY. [Before H. S. Wardeil, R.M.] , , W. Pnuo v 0. M. Brunskill—Broach Railway By-law No. 26, by allowing two horses to wander on the railway line at the Featherstou Railway Station on the 23rd October. This case'was before the Court at'iis last sitting, Mr Gray spin appeared for informant, Mr Bunny for defendant. Mr Gray said ho was now prepared to admit Mr Bunny's contention : that the by-law No. 26 was ultra vires, jand asked the Court to amend the information so as to make it read " contrary to the form of the Statute in such case made and provided."- Mr Bonny submitted the Court had no power at this stage to do so. After considerable arpi:. ment, and remarks from the Bench,'Mr Gray asked leave to withdraw the information, which was allowed, with 21s defendant's expenses, Another information was at once laid in the same case, and for the defence Mr Bunny submitted that there was no proof that the defendant knowingly and wilfully suffered the animals to stray, and that the line of railway named in tllo information was not " a railway fenced in on both sides," as the gates were continually open. His Worship adjourned the caw until 4th December to consider the point raised. Gilpin and Pardon v Charles Clifford.— Debt £3 6s lOd, Judgment by default for amount and costs Bs.
