THE HONORABLE JOHN MARTIN AND MR. G. W. SCHWART.
A third meeting or the creditors of G. •W. Schwartz, .settler,' Silverstreaniy was held on Tuasday last, for the purpose of the debtor being further examined. The Hon Mr Buckley appeared for one of the Trustees, Mr G. Allen represented the debtor, and Mr Ollivier for the debtor's son, G. M, Schwartz. Before the proceedings began, the'debtor complained of the report of his last examination, which had appeared in tho Times, stating it was •an unfair report, inasmuch as all ho had said against the Hon John Martin had been omitted, while everything he (the debtor) had said against himself had been inserted. 'The chairman (Mr Marks) said he could do nothing in the matter, as he had been asked to by the bankrupt. He hoped, however, fair reports would be given, as it was desirable everything should have the fullest publicity. The minutes of the last meeting were then read over, and the debtor suggested a number of alterations in his evidence, striking out such expressions as' loafing,' ' hanging out,' &c. Questioned by Mr Buckley, the debtor said he had settled nothing of what he got from the- Wai-henga-Hotel upon his wife. What had been settled upon his wife was a property in Vivian-street, -which Mr Martin, had' made them give up when he went to the Waihenga Hotel. The settlemeut had been made by deed—himself being /one trustee and his son the other. Ho had spent about LSOO in tho last eighteen months looking after Mr Martin. He had been manager and accountant for Mr Martin for ten years. His son had lent him moneyj which he (the debtor) had lost. The fact was, .the' boy had been a prudent boy, while he had been, foolish. Mr Buckley asked'numerous:questions, as (to the debtor's''accounts,' but' the answers were not very definifo. Mr Allen then questioned the debtor as to his transactions with Mr Martin with reference to the Waihenga Hotel.. Thedebtor said he had always had implicit, confidence in MrMartin, who, howeveiyhad used him for his own purposes [here the debtor was •affectedtotearsjin this matter.. When, once he got him in the hotel. Mi Martin would not assist him to meet his: bills until he got security' over the Yivian-st.' debtor again related the 'transaction with regard to buying some land at Featherston/and dsed some strone strong-expressions with regard- to Mr Martin. bankrupt contended .that
he had been instigated to) buy the land, which was was to be ; immediately re-sold at a profit of L3OO, whioii Mr Martin' and himself were to share, ;but when it could: not be re-sold MrMartitf would not'share; the liability,: andvrefused' fori sisteeii' months to sign the deed; ■ .■' .;'■ i'A\'. ■-'* '■■'■: ' George M, Schwartz,*, debtor's son, questioned by Mr Buokiey, said he should refuse to say how much money ho had accumulated while in his fsther'sservice. Since leaving the hotel he had lent his father about £l7O. There was.no understanding between himself and his father that the latter was to get the S.ilverstream property (now held by witness) when he got, clear 1 of. his bankruptcy.—Mra Schwarz, onjbeiug called, refused at first to be swornj-but ultimately consented. She deposed-, that Mr Schwartz had settled £IOO on her, but it had to be taken to pay his debts. The £IOOO was a mortgage over Featherston property, Everything had'been sold to pay the expenses of running after Mr Martin.-The proceedings thon ended,—N,Z, Times.
