Sir -I have observed in the list of members who attended the hat nicotine ot the Cemetery trustee, that Mr Bunny was absent, I was sorry to observe that in your report of the meeting, as it appeared a legal question cropped up regarding rules and regulations for the maiwement °J?Q™ OoI V^ ST y' UlMlcl ' the Ccmeteiy Act ot lm, while some member appears * of opinion that the Trustees are legally ' constituted under and by virtue of the public Park and Cemetery Act of 18yo So for, however, I am able to understand from both their _;.ets, without le«al assistance, I believe that the (Wory Trustees have powers delegated to them under both Acts. _ Prior to the Cemetery Act of 1877 com- j m» into force the land comprised in tho » Act of 1970, was handed over to them by tho Education Board for burisl purposes but the section adjoining the old bttryitx' ground, namely 105, which now forms the new Cemetery, was not included in the conveyance provided by the Act of 1875, as it was set apart in 1801 by Dr Featherston for cemetery use f urtheractioii therefore was necessary on the part of the Trustees, and accordingly in February 1878, His Excellency the Governor h" proclamation constituted section 105 a cemetery, under the inrnageineiit of the old Truseees, in accordance with the Cemetery Act of 1877. It appears to me therefore that the iilasterton Cemetery Trustees have duplicate powers conferred upon them under the Act of 1875 and 1877, sntl that they would be justified in framing rules and regulations in compliance with tho ColoniaLSecretary's circular under the act of 1877. It would not, however, bo wise, I believe, for the trustees to abandon the powers conferred upon them by the Act of 1870, as in that case they would lose the management of the surplus land, now let at a fair rental.
