To the Editor of tk Wakuiiam Daily Sir—ln your rejoinder to Mr Pharazyn's letter published in your issue of the 29th inst,, you wo good enough to permit me the use of your columns for the purpose of defending myself against a charge of gross partiality mado therein. In availing myself of your permission I will, at the outset, readily admit that I was unwittingly led into an error in reporting the summint; np as follows: " That the Bench had no difficulty in coming to the conclusion that there'had been an evident desire on the part of'the defendant to mislead tho plaintiff as to the price obtained for the land." In explanation, I can only say that I was not present at the conclusion of the caso, and had to rely for my information on the testimony of a gentleman who was present throughout, and who, althongh now proved to have been mistaken, I havo every reason to beliovo is perfectly free from any bias in the matter. As to tho omission of Mr Pharazyn's own evidence, I will content myself with-saying that it is-not desirable to crowd out tho whole spaco of a journal by reporting evidence which is merely a repetition of that given before, and does not adduco any new facts. Lastly, as to the suggestion of personal feeling, I need not reply to that .beyond stating that I have not the honor of more than tho merest casual acquaintance with either tho plaintiff, defendant, or any other party interested in the. suit, and have never had a business transaction with any of them. Ido not conceive that I am calleijupon to reply to that portion of Mr Pharazyn's letter which merely gives an expression of his own .opinion on the merits of the caso; but I apprehend that your readers will be ablo to judge from the matorial points of'the evidence, so as to bring their verdict in accord with "judgment for amount claimed, with costs."—Yours, &c, ■ , Occasional Correspondent.
