SHOOTING NATIVE BIRDS.
An important decision was given bj Mr Cruickshank, S.M. at Kaitangata, in a case in which a man was charged with killing native game out of season. Mr Finch, for the defendant, sub milted that at present it ia no offence to kill native game in New Zealand. In support of this contention he pointed out that at common law it was not an off'.'iice to kill native game, and that section 17 of the Animals Protection Act, 1880,'which made it an ofience to do so, had been repealed by section 5 of the amending Act of 1900 and had not boon re-enacted, as it ought to havo been. Tho Magistrate (Mr Cruickshank) upheld the contention and dismissed the information. This means that there ia no protection for ducks, etc., at present.
