■ ■■■ \J - 1 ■ 1 Waimate, Wednesday, Oct. 9th. (Before Messrs J. Manchester and E. J. Atwill, J’a.P.) ASSAULT. W. Jackson pleaded guilty to a charge of assaulting Edward Ellen on the night of Monday, October 6th. Edward Ellen stated that he bad been walking along Harris street on the night in question, and someone rushed out on him and struck him in the mouth with a stick. He was knocked down and rendered unconscious for some time. He had gone to the doctor’s about one o’clock on Tuesday morning. Ha had £1 18s in his pocket when knocked down, but next morning the £1 was missing. He may have lost it. He was not altogether sober at the time. .He did not wish to press the oase,_ and was willing to withdraw it if the accused would pay expenses. The Bench declined to withdraw the case. THEFT. W. Jackson was then charged with stealing thirty packets of cigarettes, valued at 15a, on Tuesday, and pleaded guilty. Constable Christie, stated that accused had been in the employ of Air Middleton. For the past few weeks the latter had been missing small articles, and having informed the police, Constable O’Halloran watched, and caught accused on Tuesday stealing the cigarettes. The Bench retired to consider both cases. On returning, Mr Manchester pointed out that accused had lendered himself liable to a penalty of £2O or three month*’ imprisonment for theft. The Bench considered the fact that there wasno previous conviction, and sentenced accused to one month’s imprisonment at Timaru. As regards the assault, accused had committed an aggravated assault which might have ended in the death of the victim had the blows fallen on any other part. Accused was sentenced to one month’s imprisonment on this charge also, the two charges to be cumulative.
