The Conway Case.
Sydney, May 3. The hearing of the application, on behalf of Jane Smith, for the attachment of-Watfein Wynns, publisher of the Daily Telegraph, in conned ion wiih the publication of certain statements in connection with the Conway case, is proceeding before the full Court. The Chief Justice asked whether, as Mrs Smith bad to again stand her trial* an application of this sort was not likely to do a great deal of mischief. The papers could not be stopped from publishing these proceedings, Counsel for the applicant said the object was to prevent further publication and to keep the adniini tration of justice.absolutely pure. He preferred to go on with the matter. In the contempt cases the affidavits of the sub editor of the Daily Teleg; apt and erf Wynne, the publisher, show t at the matter complained of appearedinadvertently, and steps were immediately taken to prevent anything of a like nature again appearing. The Chief Justice, delivering judgment, said the paragraph-did at the time of publication t< nd to interfere with the administration of justice, bul he c uld not see that any mischief w/mld now follow from the article, it having appeared before the first trial, wherein the jury disagreed. The Telegraph had been technically guilty of oomempt, bub he came to the conclusion that he ought not to inflict punishment. Justice would be met by ordering each party to pay their own cos‘s. 1 Similar orders were made in regard to the Newcastle Morning Herald, the Australian Star and the Sunday Ti aea.
