Magistrate’s Court.
(Before Air Waddell, S.M.) Thursday, February 14. SEPARATION. Airs McCarthy applied for a separation order a ainot her husband, Jeremiah McCarthy, who was sentenced to seven years imprisonment for incest at the Supreme Court .sittings last week, also for the custody of three children under fourteen years .of ago. Air White appeared for the plaintiff. Mr Hamilton, the defendant’s solicitor, opposed the hearing of the case in the absence of the defendant, but he (Mr Hamilton) had received no instructions •to appear. The evidence was heard, Mr Hamilton withdrawing from the case. The plaintiff gave evidence as to the -cruelty of the defendant, who had systematically ill-treated her for the lust five or six years. Kate McCarthy, a daughter of the plaintiff, corroborated her mother’s statementThe application was granted, and an order was made for the payment of 20s per week for the plaintiff and 10s for each of the children, with costs, plaintiff to have custody of the three .children. CONVICTS FORFEITURE ACT. Mr White applied, under the Convicts Forfeiture Act, to have Mrs AlcCartby appointed as administratrix of the estate of Jeremiah McCarthy (now serving a term of seven years’ imprisonment). His Worship said he thought he should not appoint the wife. The application was granted, with Air R. Hicol as interim curator in the .estate. .CIVIL CASES. Nicol and Scott v. J. Hall was •adjourned till February 28th, on the application of the plaintiff. A number of other cases were settled .out of Court. OLD AGE PENSIONS. A large number of renewals of old Age pensions were granted, besides jpyejM ones.
