sale. Mr Leifcch had come to his place, in company with Mr Buchanan, whom he did oot know as an agent, and asked to buy some lambs. He was shown a sample inthe yards, And then the two got into Mr Buchanans trap and drove to the paddock, where the deal was completed. 6. Buchanan, agent for the. National Mortgage and Agoncy Com pan), gave evidonee that he had gone to Mr Arming's with Mr Leitcb. It was practice for the agent, who introduced a buyer, to get his commission. Had beon introduced to Mr &.nmng in rim&ru. R. Leitcb., defendant, considered it the custom to pay money to the agent who was with the buyer, aad he got his commission. Had gim to plaintiff's place with" Mr liachanan. Thought plaintiff knew Mr Buchanan was an agent. W. J. Dailey, commission agent, deposed that the usual custom was for the buyer to pay the company, and the company would pay-lhe seller, Ipss agent's commission. If he were a stranger, would make himself known as an agent. J. Lefevre, farmer, also gave evidence as to the custom in regard to 'money paid. C H. GuLhrie, manager of National Mortgage and Agency Company also evidence. Ml- Arming had called at his office, and he bad explained' the matter. Plaintiff had admitted knowing Buchanan was an agenc, but he said he oniy recognised Leirch. This was all the evidence. Judgment was given for defendant with costs £2 2s, and solicitors fee £1 Is. Manchester Bros. v. W. H. Brunton, claim £31 18s 9d. No appearance of defendant, who was ordered to pay costs now amounting to £28 lls 6dforthwith, in default 80 days in Timaru gaol. Park v. Henery, claim £'> 31 s 2<i Mr Hamilton for plaintiff and Mr Clement for defendant- - Judgment for plaintiff for the amount ciaimod and costs £1 lls. • SUBSTITUTION QKDEB. Mr Hamilton applied for an order substituting the name of Leonard Price for fchat of the lafce Prederict Hughes. OLD AOK PENSIONS. Three old age pensions were granted for the full amount. The Court rose after having been adjourned twice during the day.
