When he did discover the I error, he had supplied 201 gallons extra, thus losing £22 12s 3d, and the repairs cost him £3 12s. The Magistrate did not think it was a duty devolving on Mr ; Milsom to measuie tbe kegs. The loss should be actual loss without the profit, or Is per gallon and the labour. Judgment uas foi plaintiff, £10- Is, labour £3 12s, and costs £3 ss. Mi Clement, counsel for defendant, gave notice of appeal.
