RESIDENT MAGISTRATE'S COURT.

(Before G.ft. FitzGerald, Esq., R.M.) Thubsday, Octoijer 25. Drunk and Disorderly. — Duncan M'Donald was charged with these offences, and fined 5s for drunkenness, and 15s for disorderly conduct. In default of pay- •• ment forty-eight hours imprisonment. * Drunkenness. — Jessie Gilmore was mulcted for this offence, in the sum of 5s \- in default of payment forty-eight hours' imprisonment.

Unsound Mind. — In the case of William Henry Thomas, charged with being of unsound mind, his Worship, after hearing the medical testimony, committed prisoner to Sunnyside, Christchurch. Vagrant — Wm. King, on remand from Wednesday last, was placed in the dock, charged with having no lawful visible means of support. The case had been adjourned to enable prisoner to procure the attendance of witnesses. He called James Atley, who, being sworn, deposed that prisoner had been working for the last fortnight at the launching of the p.s. Persevere. He (prisoner) always worked when the tide permitted. His Worship discharged the prisoner.

CIVIL CASES. Morison and Law v. Greer. — Mr Rees for plaintiffs, and Mr Button for defendant. This case'had been adjourned for the purpose of procuring the testimony of Capt. Malcolm, and it now appeared that the plaintiffs were still unable to obtain that gentleman's attendance. After hearing counsel on both sides his Worship said he would give judgment to-morrow morning (this day).

Campbell and Co. v. Brain. — For goods sold aud delivered. No appearance of defendant. Judgment by default. x Payne v Barnard. — This was an action for goods sold and delivered No appearance of defendant. Judgment for plaintiff for amount claimed and costs. Bank of New Zealand v. O'Loughlin.— Mr Rees for plaintiffs, Mr Button for defendant Owing to some informality in the service of the summons his Worship said he would not hear the case that day, and would direct the plaintiffs" to issue a fresh Bummons. Dougherty and Co. v. Murphy. — This was a claim for L 95, the value of four head of cattle, sold and delivered by plaintiffs to defendant. Mr Button for plaintiffs, and Mr Harvey for defendant. After the case had been partially heard, Mr, Button (on , behalf of plaintiffs) elected to take a nonsuit. Jamieson v. Jackson. — No appearance of defendant. Judgment for plaintiff for 'amount claimed and costs. \ Dougherty v. Barnard. —Action to recover the sum of L 45 13s 6d due on a promissory note. Mr Button for pltiintiff. No appearance of defendant. ' Judgment by default for amount claimed and costs. ' Marks v. Solomon —On the application of Mr Harvey, the hearing of the case was deferred till Thursday next. Launtz v. Hall. -Mr Johnston for plaintiff, andTVlr Button for defendant. This was an action for damages, by reason of the plaintiff having assaulted the defendant at Teremakau. The evidence was very conflicting,. and after Mr Button hed addres>ed the Court, bis Worship gave judgment for defendant with costs. Watkins v. Nolan. — Claim for money payable for goods sold and delivered. No apptarance of defendant Judgment for plaintiff for amount claimed and costs. The following cases' were dismissed owing to the non-appearance of plaintiffs or defendants : — Morau v. Martha, Munson v. M'Kay, Turk v. Brain, Carty and another v. Martyr and Co. ; Manuel v. Cameron. The Court then adjourned till 11 a.m. this morning. '
