(Before G. G. FitzGerald.R. M.) Wednesday, Mat 2. Drunk and Disorderly. — Chas. Laurie, James Scott, and Joseph Ilaughton, were severally fined £l for this offence, or in default, 48 hours' imprisonment. Wilful Destruction or Government Property. — James Scott was also charged with tearing Constable Carr's uniform, when he arrested him for the last offence, and was ordered to pay 15s. Drunk and Incapable. — Michael Madden was charged with being drunk and incapable, but as he had not recovered from the effects of his spree, the Magistrate ordered him to be locked up until tomorrow morning, to allow him time to get sober. Larceny. — Thomai Cain was charged by George Thomson with stealing a shirt and sheet, of the value of 15a. It appeared the prisoner had taken the articles off a fence in a right-of-way leading off Revtll street. Gray v Kennedy — For timber sold and delivered. Judgment by default for the amount claimed, £10 13s 9d, and costs 14a Byrne v M'Cormack— For goods sola and delirered. Jndgment by default for the amount claimed, £7 ss, and costs 4s. O'Driscoll v Callan— Judgment by default for £io 3s, and 6s costs, for goods sold and delivered. Gray v Rogers and Hawkesford— Mr Johnson appeared for the defendants. The plaintiff sought to recover the sum of £4 10s 9d for timber sold and delivered to the defendants; Mr Keidj manager for" Mr Gray, timber merohant, appeared 6A his behalf, and proved the claim. Mr Johnson called Henry Hawkesford, who said he had entered into partnership with Rogers in Dunedin, but that they had dissolved partnership on their passage from Dunedin to Hokitika. He worked for wages for Mr Reid in Hokitika, but was i never in partnership with him. By the Bench : Never told Mr Reid he was In partnership with Rogers. I had signed the delivery book, " Hftwkesford for George Rogers. Mr Fitzgerald said it was evident that in the first instance a partnership had existed, which had never been publicly dissolved, and further, that in the delivery- book which the defendant (Hawkesford) had signed, the items "were headed Rogers & Co. Judgment was given for the amount claimed, £4 10s 9d, with costs 7s. In the cases of — Boyle & Co v Williams and Po ; Doodward v Lewis,Chambel's &Co V Malony, M'Febuck v Malony, M'Carthy v M ( Cormack & Co, Ryan v Ryan, Rimmer v Evans & Co, Rimmer v Ryan, there was no appearance of plaintiffs or defendants. Mr Price took his seat on the Bench, when permission was given to Bett's and Co. to slaughter on Campbell and Milburn's licensed premises.
