RESIDENT MAGISTRATE'S COURT.
(Before G. G. Fitzgerald, R. M.) Monday, April 16. Lunacy. — Henry Harriett and Jane Lyons were brought up on remand, from the L4th instant, charged with being of unsound mind. They were both discharged on the evidence of Drs. llyley and Bcrmlt. Drunk and DisoRDBRiiY. — William Noonan, Lewis Marchant, James McLellan, Thomas Smith, Maurice Ford, and Patrick Kelly, were severally fined £1 for this offence, or in default 48 hours imprisonment. CIVIL CASES. JtfcOarthy y. Hepburn. — Mr Campbell for the plaintiff, Mr Oakes for defendant. This was an action to recover the sum of £19 14s. for damage sustained by plaintiff in reference to five bags of malt, brought from Greymouth to Ilokitika by the defendant in the s.s. "\Villiam Miskin. Plaintiff said that the whole five bags were received by him, and that they were spoilt and had the appearance of having been lying in water. Mr Pizzey corroborated the plaintiffs testimony as to the malt having been damaged, so much as to be unfit for use. — Butement, brewer, Greymouth, stated he had sent borne malt to plaintiff per Miskin, at the time the malt went on board the steamer was coaling Witness had no knowledge of an accident having happened to the Miskin. Crossexamined: — He did not see where the malt was stowed, it went down the fore hold. Hepburn said the ship had sprung a leak after she had put to sea. Mr Fitzgerald gave judgment for the defendant with Ids cost. The Court was then adjourned until 1 1 o'clock this day.
