Mr Campbell appeared for the plaintiff; the defendant beiug absent from New Zealand, was not represented* The plaintiff, Captain Agnew, was examined by Mr Campbell, and stated that lie had a claim on Captain Wood, owner of the schooner Tommy. lie served a summons on him the night beftji'3 lie left for Melbourne. Got a verdict aguinst him at the Kesidcnt Magistrate's Couvt for £37 5 s 9d. He then served the garnishces, Messrs Sheppard and Savers, thiough his solicitor, with a writ of foreign attachment. Mr Sheppard was examined, and stated that lie was a member of the firm of Gr. W. Sheppard and Co. Captain Wood left cortain goods in their hands for sale, with instructions to sell, and put proceeds to his credit in payment of cash advanced for freight, &c. Ho had offered the goods several times for sale, but could not find a purchaser. The garnishces then took them into stock, at a. valuation above their market value, and were prepared to pay the small balance in their hands to plaintiff. His Honor in giving the order, said that the only question for him to deal with, was whether the property the garnisbees held in their possession was the property of the defendants. They acknowledged a certain amount, which they were willing lo pay, and he would give an order forjtbat amount. The garnishees applied for expense;; for at* tonding Court, which were allowed, Tills? wan the only oase before His Honor.
