This case, our readers will remember, was recently adjudicated upon in tho .Resident Magistrate's Court. Jt was brought to recover damages fur. losses sustained through tho " deviation" from her advertised cour.'ie, of the steamship Maid of Iho Yari'ti, whereby she became a wreck, through not striking tho proper channel across the bar. Judgment was given for the plaintiff for Iho full amount claimed. The arguments and tho cases cited by Mr South, who appeared for Ibo plnintill, were reported at length in our coin tuns. Tho case appears to have oxcitod considerable attention in Dunedin, both tho report and the. comments we. made upon it as illustrating tho necessity for tho localisation on Iho West Coast of a higher judicial authority than a Resident Magistrate, being ijuotccl. As we remarked at the lime, the ease- involved questionsfiirloo large loniakoitfair to ask a .Resident Magistrate to prououueo upon them. The case has not been allowed it, appears, lo stop at. its present stage. The O/fif/o Daily Tlincn of the I7lh instant states: — ''An order has been njaclo by the Supreme Court to slay proceedings iv the cases of Sloan v. Hughes, which was recently tried iv the Resident Tvlagist.'iite's Court at ilokitika. and which involved some, important points ofnuuitimo law. The injunction 'was granted en the grounds that the trial was informally laid and otherwise irregular."
