CIVIL CASES. Davis y Soloman.— Claim for Ll9. Mr O'Loughlin for defendant, Mr Oakes for plaintiff. Mr O'Loughlin applied for a fresh summons. Application granted. John Cohen v G. Heed. — Case dismissed. Dam v Soloman. — Mr Oakes appeared for plaintiff, defendant not appearing. Judgment for plaintiff. Watkiu v Fitzgerald. No appearance. Munroe v Scanlan. — Judgment by default. Johnson v Freeman. — Settled out of court. Honoyman v "Zealand. — This case was heard on the 14th instant, Avhen his worship decided on granting a fresh hearing. This was a claim for L 5 passage money agreed to be paid for defendant's passage back from Ilokitika to Duuedin. Stephen Honeyman stated that ho was engaged as seco ad engineer on board the Lady of the Lake, and in that capacity agreed to bring the vessel to Hokitika, at which port he was to be discharged and receive a passage, or the equivalent, from Captain Zealand, back to Dunedin. Upon applying to Capt. Zealand he had refused [to pay the passage money, alleging as his reason for refusing to do so that he had not engaged him, the plaintiff, and therefore know nothing of tho matter in dispute. Tho plaintiff then called Wm. Kerr, tho chief engineer on board tho Lady of tho Lake, who stated that the plaintiff had been engaged on the terms mentioned, on condition that ho behaved himself, and that, in lieu of receiving his passage money, ho was to have been sent back by tho Albion steamship as soon as she arrived. Amos Law corrof borated tho last witness's evidence. Thos. Zealand, master of tho Lady of the Lake, stated that the late engineer, Mr Douglas, had engaged plaintiff in Dunedin, but that ho, defendant, was not aware on what torms. In answer to questions by his worship, tho defendant stated that ho was totally ignorant of tho arrangements that wero made with his engineers, that ho had no artio'es on board, as he expected the vessel to be sold on her arrival. His worship decided that as ho, defendant, had paid plaintiff his wages, and was ignorant of the agreement made in Dunedin, ho

tamst decide in favor of the plaintiff, viz., that he was to receive a passage by the Albion steamship as soon as she arrived.

Friday, 18th August. John Barwon, charged with being chunk and disorderly, was fined LI, or 48 hours' imprisonment. Wm. Ilolt, for being drunk and incapapable, fined L I or 48 hours. Charles Lear, brought up charged with robbery from the person of one Wm. T. tton at the Kanieri, was remanded till the 23rd iastant.
