M'KENZIE v. HOLMES, AND HOLMES v. M'KENZIE.
TO THE EDITOR OP THE WEST COAST TIMES. Sir, — In your correspondents' column of tho 22nd inst., my attention was drawn to a lottov respecting tho abovo case, and signed by aAh Oakes, who I am informed is a solicitor, and whose statement is a perversion of tho truth. I shall therefore givo you tho facts of tho case. I received power of attornoy from Mr Thomas R, M'Konzio to recover the sum of L2O from Holmes. On the 12th inst., I served him with a summons returnable on tho 18th inst., aud instead, as Mr Oakes stated, being at tho Waimea, he was at Mr Evans' butcher shop, situate in Revoll-strcet, Meanwhile he takes some cattle up to tho Waimea. One breaks its leg ; on Saturday, 13th inst., ho slaughters and sells tho greater portion of it, leaving the remainder to be disposed of by a Mr Bulstiom. On the same day, finding that I could not obtain somo witnesses, I called to sco Holmes, who, Mr Evans informed me, had not returned. On the Monday morning I left a notice of discontinuance of action at Holmes last place of abode. I also gavo a similar notice to the Eonch. On the 19th inst, having other business at the R.M. Court, I was surprised to hear the case called on. I naturally responded, and oalled tho Resident Magistrates attention to my notice of discontinuance! which I uphold was legal. Defendant applied for expenses. Mr Soliaw, the Resident Magistrate, advised him to summons, and that evening about 8 o'clock I was served with a summons accompanied with a bill for the moderate sum of L 6 Bs.
I appeared tho following day and applied to havo the case adjourned in order to produce material evidence. This was opposed by the yclept Waimea butcher and Mr Oakes, but very properly granted by Mr Revell, the Resident Magistrate. Tho case was heard by Mr Sale, and although I had to contend against tho " knight of tho cleaver," and the Ohrtstohuroh la\vyor,'thoy only succeeded in recovering L 2 14s.
Mr Oakes alludes to his boing interrupted by mo in a most unwarrantable and ungentlemanly manner while ho was endeavoring to explain the caso, whioli was a very simple one* I merely observed that his attempted explanation was " preposterous," and calculated to mislead the Denoh.
As regards his sourrilous attack on Mr Revoll, the Resident Magistrate, that gontleinan's character is too well known to be affected by its malignancy. I am, &c, J. B. Nktixeivwood, Mining Advooato and Agent.
The lato assassination of President Lincoln imparts an additional interest to tho following, which appeared in tho advertising columns of tho " Sclnia (Alabama) Dispatch" :: — •« One Million Dollars \Vanted, to Have Peace by the Ist of March.— lf tho oitizens of the Southern Confederacy will fuvnish mo with the cash, br good soourities for Iho sum of 1,000,000 dols., I will cause tho lives of Abraham Lincoln, William H. Seward, and Andrew Johnson to bo taken" by tho Ist day of March. This will give us penco, and satisfy the woild that cniol tyiunta cannot live in, v ' land of liborty.' If this is not accomplished, nothing will bo claimed beyond the sum of J50,000 dols. in advance, which is supposed to be necessary to reach nml skiughtor the thieo villains.
