{PEB .UNITED PEBBB A8800UTION.) : ; New Plymouth, November 8 ;- • The appeal by the ratepayers against the New Plymouth harbour rate wag .heard to-day before Judge Gilliea, Mr Govett (instructed by Mr Travers) appearing for the ratepayers, and , Mr Samuel for the board. Ban Honor <iU« missed the appeal with coatß. At the same time, he remarked that he saw no grounds whatever for doubting that the rate had been properly levied. Le&va ■' to appeal to the Court of Appeal waa . only granted upon Jiffr; Samuel consent* ing and pointing out that if it was not 1 granted the ratepayers would prppably move to the Supreme Oourt in the first instance for a writ of ccrtiorare, and then take the appeal to the Oourt of Appeal as a matter of right, thus entailing six months' delay and a very largely increaßod expense, and possibly preventing the ratepayers from paying their rates and , supplying : funds to meet the coupons bn! the loan.
