The claim was in respect of hire of a threshing machine and labour employed inthreshing thirteen stacks of wheat on Mr James Durie's property at "Waitotara, "which was undertaken by. the plaintiff at the request of and as ageut for the defendant. The defendant considered the charge excessive! and had tendered £8 iu settlement, which plaintiff refused to take.'
