LENGTHY SITTING. DRUNKEN MOTORIST FINED. (“Times-Age” Special.) * A sitting of the Carterton S.M. Court was held yesterday before Mr H. P. Lawry, S.M., Judgment was given for plaintiff by default in the following cases: Gordon Hughan, Limited v Lieutenant R. Maiden, claim £l7 Is sd. Carterton Borough Council v D. J. Gillespie, £24 14s 6d. John Hayes was charged that between March 1 and October 9, 1942, at Masterton, he received a pair of binoculars valued at £5, the property of the New Zealand Government Army Department, knowing them to have been dishonestly obtained. . Accused pleaded guilty and was admitted to nrobation for two years. Eric V. Baird was charged with having been found intoxicated while in charge of a motor car on June 26 at Carterton and was fined £5, and Ills licence cancelled for twelve months. Leslie A. Rzoska was fined £1 with costs 10s for having driven a motor car through High Street, Carterton, without due care and attention. Mervyn T. Quinn, for having driven a car without carrying a warrant of fitness, was fined 5s with costs 10s.. Vincent E. Carrig was charged with having driven a motor bus over a railway crossing when the line was not clear. Counsel for defendant (Mr McKenzie) stated that owing to the foggy weather his client did not see the railcar approaching and was of opinion it had passed ahead of him. The Magistrate imposed a fine of £lO, with 10s costs. W. G. Morris was charged that on March 1, at Carterton, he purchased petrol under a consumer's license and that he used such petrol otherwise than for the purpose set out in the application. As it was a technical breach the Magistrate fined defendant £2 with costs 13s. The following were proceeded against by the Traffic Officer (Mr A. E. Ansell) for having exceeded the speed limti and were fined the amounts stated:—Roy Jan Mignot £3. costs 12s; D. F. Andrews £3, costs 10s; P. G. Thomas £3, costs 10s; W. R. Levin £5, costs 10s; H. W. Mullis £l, costs 10s; A. J. Corlet £2, costs 10s. . John Howell, on a charge of having carried on a goods service in a controlled area, otherwise than in conformity with the terms of such licence, was fined £l, with costs 10s. For having carried an excessive load Transport Wairarapa Ltd was fined 30s with costs 10s. t The Traffic Officer proceeded against Martin Smith on a charge that, on May 28 at Carterton he permitted the operation of a passenger service vehicle along the Main Highway when the passengers exceeded the limit* fixed in the certificate of fitness. Mr T. Jordan for defendant said that the bus services had been cut indiscriminately. He had appealed to the authorities against the curtailment qnd had even, in the interests of the public, telephoned to Wellington and urged that something should be done to alleviate the situation but had received no reply.

Mr Lawry said he had received several complaints regarding the overloading of buses and if this continued there would probably be an accident. It was to prevent this that the action had been taken. In the circumstances he thought the Department should be informed in regard to the position by the Traffic Officer. A fine of £2 with costs 10s was imposed. H. L. Quin was fined 10s with costs 12s for having operated a motor car without a silencer. The Commissioner of Taxes brought charges against the Carterton Trust & Agency Company that on Mjirch 2 at Wellington and Carterton, being a company in business during the year ended December 31, 1941, failed to furnish to the Commissioner of Taxes within two months of the date of the annual balance a return in the prescribed form setting out a complete statement of all the income derived by it during the year ended December 31, 1941; also that on March 1, 1943, at Wellington and Carterton during the year 1942 failed to complete a statement to December 31, 1942. A fine of £5, with costs £3 13s, was imposed on the first charge, and a fine of £2 and £1 Ils costs on the second. A charge against Percy Rayner brought by the Wairarapa South County Council, in respect of cattle having been allowed to wander at large contrary to section 17 of the Impounding /let, 1908, was dismissed. The case in which the Carterton Borough Council charged seven owners with having allowed dogs to wander at large or without being under control in High Street, Carterton, was adjourned until August 11, 1943.
