CHARGE FAILS

MAGISTRATE HOLDS EVIDENCE TO BE INSUFFICIENT. At the Masterton Magistrate’s Court today, the Borough Traffic Inspector, Mr J. McGregor, proceeded against I. Allan and Sons, Ltd., on a charge of having operated a heavy motor vehicle without it being equipped with two independent brakes, in compliance with the requirements of the traffic regulations. Mr S. V. Gooding appeared for the Borough Council. Mr J. Macfarlane Laing represented the defendant company, and entered a plea of guilty. After hearing considerable evidence the Magistrate dismissed the charge on the grounds that insufficient evidence had been brought forward by the prosecution to show that the brakes were not effective from any other cause than immersion in water.
