MAGISTRATE’S COURT

SITTING IN MASTERTON FRUIT MARKETING. HASTINGS GROWER CONVICTED. The fortnightly sitting of the Masterton Magistrate’s Court was held this morning. Mr H. P. Lawry, S.M., was on the Bench, Ernest Shenton French, fruit grower, Hastings, was convicted and ordered to pay 12s costs and £3 3s solicitors’ fees on a charge of having sold apples to Fielding and Co., Masterton, in contravention of the Apple and Pear Marketing Regulations, 1940. Mr R. R. Burridge appeared for the Marketing Department. Evidence was given by Mr Mason Davey, fruit inspector, Masterton, that he had found French’s orchard number on three cases of fruit in Fielding and Co’s shop. French was 'an orchardist in a large way and was not a grower-agent under the registration. Mr Lawry intimated that as the case was the first of its kind heard in Masterton he would impose a nominal line. On a charge of having failed to enrol under the National Service Regulations, Oliver Gemmell was fined £1 and 12s costs. Ernest Ronald Jeffcoat was fined £1 and 10s costs for having been in possession of liquor near a dance hall in Masterton on June 28. 1 Alfred Midhurst was fined 10s and 10s costs for having ridden a motor cycle without a warrant of fitness on July 5. The borough traffic inspector, Mr J. McGregor, prosecuted. Frank Armstrong was fined 5s and 10s costs for having carried on a goods service business in a controlled area, between Woodville and Masterton without a licence. Traffic Inspector W. G. Milne prosecuted. For having permitted a cow to stray, J. W. Wells was fined 5s and 10s costs. J. Bovie was fined 10s and 10s costs on a similar charge. Civil Business. The following judgment summons orders were l made: — Yoe Wah was ordered to pay Neale and Haddow Ltd. £2l, in default «■ weeks’ imprisonment. A. V. Retter was ordered to pay Richard Thomas Betty £l9 17s, in default 18 days’ imprisonment, warrant to be suspended so long as defendant pays £1 a fortnight.
