ACTION REGRETTED
JUDGE’S RESIGNATION
TO CONTEST FEDERAL SEAT. PRIME MINISTER’S COMMENT. (By Telegraph—Press Association—Copyright) SYDNEY, September 1. The Prime Minister, Mr Menzies, commenting on Mr Justice Evatt’s retirement from the High Court bench to become an official Labour candidate in the Federal election, said: “These are no doubt matters of personal opinion, but I regard the precedent as most regrettable. The judiciary should be kept completely detached from party politics.”
He added that Mr Evatt would be an opponent of the Government and of the suggestions for a national government. His election for Barton would be a defeat for the Government and its war policy. Mr Evatt replied: “I feel that the Prime Minister, acting with scant generosity. has failed to observe the dictates of Australian sportsmanship. My decision, which caused me anxious consideration, was influenced by the almost universal appeal that every Australian who is able should assist to the utmost in obtaining victory in the war and security in peace.”
