. HOUSEBREAKER'S EXCUSE. That he had walked in his sleep, and wakened surprised to find a “house-breaking implement” in his pocket and a policeman at his side, was the explanation given to Mr S. T. Goetzsche in the Johannesburg Magistrate’s Court by Simon Cecils (21), a coloured man, who appeared on a charge of housebreaking with intent to steal and theft, and another charge of being in possession of a house-break-ing implement by night, without lawful excuse.

Mr Goetzsche found him guilty on both counts and sentenced him to a total of eight months’ imprisonment with hard labour.

The Crown alleged that Cecils broke into a shop owned by Chang Yen on the night of November 17 and stole a quantity of cigarettes and sweets. Cecils, who admitted previous convictions, said he always walked in his sleep. He was walking in his-sleep on the night Chang Yen’s shop was broken into and only woke up when the policeman caught him. He was surprised to find himself at the shop with the door broken. He was also surprised to find a spanner in his pocket.
