MONTHLY SITTING • HELD AT MASTERTON TODAY. BREACHES OF MOTOR REGULATIONS. The fortnightly sitting of the Masterton Magistrate’s Court was held in the courthouse this morning. Mr H. P. Lawry, S.M., was on the bench. Charged with having driven a motor car in Russell Street, Masterton. during the hours of darkness without a tail-light showing at least 300 feet to the"rear, David Couper was fined 5s and 10s costs. Charles Leonard Millier was fined £3 and 10s costs on a charge of having negligently driven a motor car on the Tinui-Masterton main highway on March 22.
Evan C. Brenkley was fined £1 10s and 10s costs on a charge of having defaulted for more than one month after the due date of payment of instalments of the registration levy payable on and during the period May 1, 1939, to November 1, 1939. On a second charge of having failed to pay the registration levy for the period November 1, 1937, to February 1, 1937, the defendant was fined £1 10s. and 10s costs. The charges were larct by Mr J. L. L. Wood, representing the Social Security Department. Mr W. G. Milne, representing the Transport Department, prosecuted in/' the following cases: —
Martin Smith was fined £1 and 10s costs on a charge of having operated a passenger-service vehicle on March 25, between Masterton and Palmerston North without having a certified warrant of fitness for the vehicle. On a second charge of having operated a passenger-service between . Carterton and Tauherenikau otherwise than pursuant to the requirements of a passen-ger-service license issued under the Transport Licence Act, 1937, Smith was fined £2 and 10s costs.
Patrick Wolland, of Wellington, was charged with having driven a motor cycle between Solway and Masterton and failed to display on the vehicle the distinguishing marks required by the regulations. The defendant was .fined £1 and 10s costs. On a second charge of having carried a passenger on the pillion, Wolland was fined £1 and 10s costs.
Thomas Ballon, Bertram Henry Bunny, Robert George Deane and Carl Larsen were fined 10s and 10s costs, £1 and 10s costs, £1 and 10s costs, 5s and 5s costs, respectively, on charges of having failed to carry current warrants of fitness in the vehicles they were operating on March 31, 1940. The borough hosing inspector, Mr A. E. Fellingham, brought an action against Clara Lucy Toxward for having used a hose after hours on December 20. 1939. The defendant, was fined 10s, with 10s costs and solicitor's fees 10s 6d.
Mr J. McGregor, Borough Traffic Inspector, proceeded against Alfred Whithead for having ridden after dark on April 26 a bicycle in High Street. Masterton. without a light attached. The defendant was fined £1 and 10s costs.
Frank Nelson and Jack Ryder, of Masterton, were each fined 15s and 10s costs on a charge of having ridden bicycles in Queen Street. Masterton. on April 26, 1940. after dark, without having lights attached ot the machines. CIVIL CLAIMS. Judgment for plaintiff by default was given in the following undefended civil cases:— McKenzie and Marsack v Albert Tubent. claim £5 7s 6d. costs £1 14s [ 6d: W. E. Davies v Hina Marsh, claim £9 7s lid. costs £1 15s 6d; W. Burridge and Son v W. Hales, claim £2 4s 9d. costs £1 4s 6d; N.Z. Farmers’ Cooperative Distributing Co, Ltd, v James McDonald, claim £ll 0s sd. costs £2 18s: Avon Cecil Talton and Stanley Lyell Tatton v J. W. Bevan, costs only. 14s; Frederick C. Yule v James J. Morris. claim £25. costs £4 Is Gd. In a judgment summons case R. W. Perry was ordered to pay Long and Son Hie sum. of £9 14s. in default 3 days imprisonment, the warrant to be suspended so Tong as defendant paid £1 10s per month.
