CLAIM FOR DAMAGES FAILS
LEAVE TO MOVE FOR NEW TRIAL. (By Telegraph—Press Association.) PALMERSTON N„ October 26. Judgment was given for defendant in the Supreme Court tonight in the case in which Mrs Mabel Dane Over, Palmerston North, claimed £2OOO damages from Olaf de Vantier, wood and coal dealer. Palmerston North, She had sought this sum as compensation for the death of her husband, who was kil • led in a motor accident in Taonui Street, Palmerston North, on the night of February 25 last. The driver of the lorry was Lorenz Christian de Vantier. It was contended by plaintiff that her husband was walking in Taonui Street when the accident occurred, but the defence alleged that he was a passenger on the tray of the vehicle and riding there at his own risk. The case was heard by Mr- Justice Johnston and a jury of 12. When the jury returned with its decision in favour of defendant counsel for plaintiff asked for leave to move for a new trial within 14 days. This request was granted by the judge.
