GAMING CHARGE
PAHIATUA RESIDENT FINED £75. FLEA FOR LENIENCY. (By Telegraph—Press Association.) PAHIATUA, This Day. Pleading guilty to a charge of keeping premises as a common gaming house, Joseph David, restaurant proprietor, was fined £75 and costs in the Pahiatua Magistrate’s Court yesterday. Mr Siddells, for the accused, made a plea for leniency. He stated that David might have difficulty in paying a fine because the previous day he had enlisted for active service. “We have a ludicrous position,” said Mr Siddells. “The Government is permitting gambling by art unions yet is repressing the gambling activities of those unable io attend race meetings. No matter what penalties are imposed another bookmaker soon arises to take the first one’s place. It seems to me this state of affairs will continue until the Government. sees fit to alter the legislation regarding off-course betting.” David was previously convicted in 1938 and Mr Siddells asked that the penalty be fixat the same fine as before, £25,
