Mr. Justice Smith gave judgment this morning in the case in which the "Evening Star” Company moved for judgment in its favour concerning an action brought against it by George Barclay, jockey, for damages for libel in which case the jury had awarded plaintiff £5O. The case concerned the riding of Foxglove at the South Canterbury races in April. His Honour held that the comment could no! be regarded as excessive or unfair. Judgment was given for the defendant with costs.
