DANCE ON SUNDAY
CABARET PROSECUTION IN WELLINGTON BY-LAW DECLARED TO BE ULTRA VIRES. COUNCIL EXCEEDS ITS POWERS. I (By Telegraph—Press Association.) WELLINGTON This Day. Giving reserved judgment in a case in which the proprietor of the Majestic Cabaret was charged with using a dance hall on a Sunday, following upon the hiring of the'premises by the 33 Club for a subscription dance, which continued till 2 a.m. on the Sunday morning, Mr J. H. Luxford, S.M., holds the by-law to be ultra vires. He said the information must'also be dismissed because the effect of one clause was to enforce Sunday observance —in other words observance of the Fourth Commandment—and- the' Legislature had prohibited municipal councils from making by-laws to enforce the observance of or performance of religious or moral duties.
