THREAT OF GAOL

APPREHENSION OF BANKRUPT ORDERED. REQUESTS BY ASSIGNEE IGNORED. (By Telegraph—Press Association.) AUCKLAND. June 8. Application to have a bankrupt apprehended and brought before the Court for examination was heard by Mr Justice Fair in the Supreme Court. The Bankrupt, Mrs Daisy Hilda Newbury, widow. Auckland, had been summoned to appear before the Official Assignee for examination, but had failed to respond. Mr McCarthy, appearing for the Official Assignee, said Mrs Newbury had been declared bankrupt on March 31, and the Official Assignee had required her to furnish him with a statement of her assets and liabilities and other particulars, and to come before him. She had maintained an attitude of studied indifference from the beginning. Counsel detailed various summonses to attend and give information that the Official Assignee had served upon Mrs Newbury, an.<3 sdiid she refused to do anything at all. His Honour said the provisions of the Bankruptcy Act was intended to prevent persons from flouting or disregarding obligations which the law imposed on them. The Official Assignee had shown the greatest consideration for bankrupt, and had given her more than ample time to think over the position and consult advisers. In response to that very reasonable and considerate attitude, he had received no answer of any kind from bankrupt. His Honour made an order that bankrupt be apprehended and brought before the Court at 11 a.m. next day for examination. “It would probably be as well for me to add.” said his Honour, “that Mrs Newbury should know that, if she does not furnish the information .when she comes before the Court, or attempts in any way further to impede the administration of the law. then the Court has power, which it is bound to exercise, to commit her to prison till she complies with the law’s requirements.”
