LENIENT VIEW TAKEN
DEATH OF CHILD AT LOWER HUTT. MOTORIST FINED AND ORDERED TO PAY COSTS. (By Telegraph—Press Association.) WELLINGTON, .This Day. Henry John Falleni, a hairdresser, aged 39, found guilty of negligent driving at Lower Hutt on February 19, and causing the death of an 18-months-old child, was fined by Mr Justice Smith £2O and ordered to pay costs amounting to £l6 3s 4d within two months, in default two months’ imprisonment. Falleni’s licence was suspended and he was prohibited from obtaining another for three years from today. Mr Justice Smith said the case was difficult, though the prisoner was not under the influence of liquor and there was no reason to think he would offend again. His Honour said he inclined to the view that the accident might have been due to physical exhaustion.
