APPEAL HEARING

AVES MANSLAUGHTER CASE. REVIEW OF SENTENCE SOUGHT. (By Telegraph—Press Association.) WELLINGTON, This Day. The Court of Appeal today reserved its decision on an application for a revieW of the sentence of twelve years’ imprisonment with hard labour imposed by Sir M. Myers, at Napier, on Colin Herbert Hercock, following his conviction for the manslaughter of Isabel Annie Awes at a trial for murder on October 31; 1938. Mr C. H. Weston asked the Court to reduce the sentence and change it from hard labour to reformative detention. Sir H. Ostler, who, with Mr Justice Smith and Mr Justice Fair, was on the Bench, said he did not remember such an application being made before in a case of manslaughter, but no doubt the Court had power to do it if it so thought fit.
