DISPUTE OVER HOUSE
SPECIFIC PERFORMANCE SUIT FAILS. (By Telegraph—Press Association.) WELLINGTON, This Day. An endeavour to compel a woman to carry out a promise to purchase a house in Masterton failed in the Supreme Court in Wellington yesterday. Both parties are residents of Masterton. Plaintiff was the owner of the house, Mary Robina Chunn, married woman, and defendant Daisy Eliza Johnson, widow. Mrs Chunn alleged that Mrs Johnson had agreed in writing to buy the house and land, and sought specific performance of the contract. Mrs Johnson admitted making an offer for the house, but put forward the defence that she had been induced to do so by the statement that the house was free of borer, whereas it did have borer in it.. The hearing of evidence occupied most of the day, and after an hour’s adjournment Mr Justice Smith, who heard the case, delivered a written decision in favour of defendant, discussing the evidence, much of which, he remarked, had been contradictory. Mr C. C. Marsack, Masterton, appeared for plaintiff, and Mr I. A. Hart, for defendant.
