MAGISTRATE’S COURT

BUSINESS AT MASTERTON SITTING. INTOXICATED MOTORIST FINED. The fortnightly sitting of the Masterton Magistrate’s Court was held this morning, Mr. H. P. Lawry, S.M., being on the Bench. A fine of £l5 and cancellation of his driver’s licence until October 1, 1939, were the penalties imposed on Alan Stuart Broome, 31 years of age, a labourer, on a charge of intoxication in charge of a motor car. Senior-Sergeant Doggett said the defendant was handed over to the police by Traffic Inspector Milne, who had found him driving along the Carterton Road on Friday,' September 9, in an erratic manner. Traffic Inspector Milne followed him and noticed that several cars had difficulty in avoiding a collision. Defendant was examined by a doctor 1J hours later, when ,h e was decidedly intoxicated. Mr T. Jordan, who appeared for defendant, said his client was a respectable young man who had spent a little time at the Taratahi Hotel with three companions. He was not a drinking man. Counsel .urged that it was not a case for a heavy penalty. Mr. Lawry imposed the • penalties stated, defendant to pay also medical expenses of £1 Is. THEFT CHARGES. A young man, aged 18, whose name was ordered to be suppressed, pleaded guilty through his counsel, Mr. I. Hart, to three charges of theft in respect to articles of clothing. Senior-Sergeant Doggett said the articles, an overcoat, two hats and a pair of gloves, belonging to three different owners, were taken from the Kopuaranga Hall on August 11 last. Mr Hart said defendant had had some liquor and scarcely remembered any of the events of the night in question. With some companions, he had called at the Kopuaranga Hall in the belief that a dance was being held, but had found that a ping pong tournament was being held there. He had since given the police every assistance to clear up the matter except that he declined to implicate his companions, who were considerably older than himself. Had defendant been a few months younger the Magistrate would have had the option of dealing with him as a juvenile. Counsel asked that under the circumstances defendant’s name should be suppressed. Restitution would also be made. The Magistrate suppressed defendant’s name and admitted him to probation for a period of two years &n the main charge, a condition being that he abstained from taking liquor. On the two minor charges he was convicted and discharged. Austin Herbert Thomas, on a charge of failing to give way to traffic approaching on his right, was fined £2 and costs 10s. The charge arose out of a collision at the Police Station corner. Kenneth C. McGregor, on a charge of having no motor driver’s licence, was fined 10s and costs, 10s. For double-parking his car Neville Gibson Parsonson was fined 10s and costs 10s. A. M. Rutherfurd, for operating a lorry without a heavy traffic licence, was fined 10s and costs 10s. Mr. G. D. Wilson, for defendant, stated that the lorry had only just been purchased and defendant had been under the impression that the previous owner had attended to the licence and that it was in operation. On the information of the radio inspector, Mr Burke, several defendants appeared on charges of not having radio licendes. Fines of 10s and costs 10s in each case were imposed on John Brough. John A. Kelly and Wilfred Large and fines of 5s and costs 10s were imposed on Sydney Robert Gerrand and Walter Turanga Greenland. , Bernard Jeremiah Savage, on the information of Inspector J. McGregor, was charged with driving a motor car in Queen Street at a speed exceeding 30 miles an hour. A fine of £3 and costs Ils was imposed. CIVIL BUSINESS JUDGMENTS FOR DEBT Judgment for plaintiff by default was given in the following cases in the Mastertcn Magistrate’s Court today by Mr H. P. Lawry, S.M.:—W. James v Timothy Sullivan, claim, £6 5s 6d, costs, £1 Ils 6d, Bullick Blackmore Ltd. v M. Harris, claim £3 2s 2d, costs, £1 6s 6d.

In a judgment summons case Townsend and Paul Ltd v G. Neich. defendant was ordered to pay £ll 6s 5d forthwith, with costs 12s 6d and solicitor’s fee £1 Is, in default 12 days’ imprisonment.
