U. SCOTT CASE
4 TROTTING CONFERENCE ALLOWS APPEAL. •METROPOLITAN CLUB CRITICISED. (By Telegraph—Press Association.) CHRISTCHURCH, August 25. The appeal judges of the New Zealand Trotting Conference have allowed the appeal lodged by H. Stafford, ownof of Pot Luck, against U. Scott, winner of the third heat of the third qualifying event in the inter-Domin-ion Championship. J. R. McKenzie, owner of U Scott, has been fined £25. The judgment, dealing with the change of gear made with the horse states: “In view of the fact that after purported permission was given by a member of the Judicial Committee, the Chief Stipendiary Steward told the owner that permission had not been granted, we think the owner should have taken further steps to ascertain the true position and that he failed to do so. We therefore fine him £25.” The case has been the subject of several appeals and on the subject judgment reads: —“To a great extent the trouble was created by the action of the club, whose handling of the situation, both before and after the race, left much to be desired. The result has been a succession of hearings, culminating in this present appeal, and we think the club should bear some of the cost that the conference and the appellant have been put to. We therefore adjudge that the Metropolitan Trotting Club pay the sum of £lO towards the expenses of the conference and the sum of £3O towards the costs and expenses of appellant in connection with this appeal. A sum of £2O deposited by the appellant will be returned to him.”
