JEWELLERY CLAIMED

CASE HEARD IN SUVA SUVA, April 13. In the Supreme Court, Colin Woollam Anderson, company director of Auckland, claimed from Gladys Neville Windrum, married woman, of Suva, living apart from her husband, the return of jewellry estimated at a value of £5500. Anderson said he handed defendant on December 6, 1936, 620 £1 shares in New Zealand Newspapers and a life insurance policy for £lOOO payable in 1940. He claimed that he became acquainted with defendant in Auckland in April, 1934, and in December promised her an allowance of £3OO a year, and for the purpose of securing that amount the jewellery, shares and policy were handed to defendant security. Defendant claimed that the articles were a free gift, or alternatively were given in respect of an unlawful and immoral association, during which plaintiff cohabited and committed adultery. The articles were a gift made in furtherance of that association.

In a reserved judgment the court said it was satisfied that the delivery of the jewellery and the transfer of the policy were not a gift but were made as security. The court held that the shares were transferred as a gift. Considering the alternative defence, it found on the authorities quoted that plaintiff could have no relief from the court. No order was made regarding costs.
