The Recent Tote Cases
(Per Press Association). Wellington, This day Mr Haselden, S.M., delivered jadgmeni to day in the case against Detective Broberg and two constables, who were oharged with conniving at the commission of a crime in connection with the recent tote betting prosecutions. The Magistrate held that accused were not betting for gain, bnt in pursuance of orders, and therefore, he thought, tbe present prosecution bordered on the ab surd. He knew of no precedent bearing on tbe present case, but said tbe polioe had been charged in Australia with participating in a case of attempted abortion.
Mr Haselden admitted that there might be oases in which, if the polioe connived at the committal of an offence, each con dact would bo detestible, bnt in the recent case* he could not bnt allow that the police were acting within their rights. All three informations would be dismissed with £2 2s costs. Mr Wilford, for the prosecution, said an appeal would be made on the ground that his Worship’s lodgment was erroneous in law.
