(BY TELEGRAPH.— PRESS ASSOCIATION). Auckland, Last Night. The betting case police v. D. McLe.od, in which defendant was charged with having used the Ellerslie racecourse ground tor betting purposes, was dismissed by Mr Hutchison, S.M., at the Police Court. Ihe magistrate held that the " place " in this case was not in any material way defined, defendant's only apparatus being a bag round his neck. The facts did not therefore bring it within any decided case, and the charges must fail. A "place" was not every place, for if so the Act would suppress betting entirely.
