CHARGE AGAINST A CONSTABLE.
(BY TKLKGRA]'"H— I'RKSS ASSOCIATION). DcNEDIN, Last Night. At Alexandra this week, Scrgt. Scully, who was recently transferred to that district, was charged with stealing a bottle of gin from the Dunstan Hotel. The evidence of the wife of the manager was to the effect that while she was in a room from which she could see the bar Sergt. Scully came in on tip toes, and alter peering round took up a full bottle of gin, placed it under his coat, anil was walking out when she called her husband. For the defence itwascontended there was no criminal intent. Accused, in giving evidence, said he had no recollection of taking the bottle. If he took it he did not intend to steal. He had been in bad health of late, suffering from insomnia. Numerous annoyahces had been preying on his mind and affected his brain. He had been advised by a Chaistchurch chemist to take drink to get rid of the influenza, and he had been drinking since he went to Clyde. Mr McCarthy, S.M., said he must take it that accused was quite sane at the time ; but as it was his first offence, accused would be admitted to probation for six months, during which he must consent to the issue of a prohibition order against himself.
