COURT OF APPEAL

(by telegraph—press association). Wellington, Last Night. In the case Dye v. Baker, the Court of Appeal was equally divided in opinion (Mr Justice Deuniston and Mr Justice Edwards being of opinion that the appeal should be dismissed, and Mr Justice Conolly and Mr Justice Pennefather dissenting. The judgment of the Court below therefore stands. Judgment was also giveu in the case Mayor of Auckland v. Speight. Their Honors, Mr Justice Denniaton, Mr Justice Edwards, and Mr Justice Conolly, being unanimous in the opinion that the appeal should be dismissed with costs.
