CHARGE OF ASSAULT.

[K\ TELEGRAPH.— OWN CORRESPONDENT). Auckland, Last Night. Jeremiah DRISCOLL, John Hetherington, and Thomas Wilson were brought up at the Police Court before Mr T. Hutchison, S.M., charged with assault, causing bodily harm, theft, robbery, and personal violence near the Harp of Erin on March 25th, the assault being on Win, Macmanemin, Wm. Tindell, aud Walter Absolum. After considerable evidence had been beard, the charge was changed to one of common asßault. Wilson was discharged, there not being sufficient evidence to implicate him. His Worship Faid that Hetherington and Uriscoll had committed au entirely unprovoked assault. Hetherington's offence was not so grave as the assault committed by lMscoll. It was a case for imprisonment only, and Hetherington would have to go to prison for two months anil Driscoll for four months.
